Tenants in Common Disputes

By:Fadhrick Pickaso

The acronym "TIC", which stands for tenancy in common along with the terms "co tenancy" and "fractional ownership" refer to arrangements under which two or more people co-own a parcel of real estate without a "right of survivorship" This type of co-ownership allows each co-owner to choose who will inherit his/her ownership interest upon death By contrast, the type of co-ownership called "joint tenancy" requires that each co-owner's interest pass to the other co-owners upon death
Common Disputes
Whether, a tenancy in common or a joint tenancy, Aside from logical mediation and negotiation, a tenant can apply to the court pursuant Most commonly, the court will appoint a trustee to oversee the sale of the property However, there are other solutions The most complaints are usually about: access to the premises by the landlord/agent; maintenance of the property; and withholding security deposits Some of the most common disputes between landlords and tenants involve nuisance behaviors such as loud music, rowdy guests, unkempt property and other annoyances Usually the landlord has to intervene because he or she has received several complaints from other Tenant in Common regarding another resident's behavior When confronted, many of them will either take offense or claim that their actions are justified or permitted under the current lease agreement Landlords and tenants also frequently clash over housekeeping and upkeep Another common problem that exists between landlords and tenants is disagreements over maintenance and repairs Fake Watch. Disputes can arise when Tenants in Common find their security deposits have been used to repair damages, replace carpets or cover unpaid utility bills A tenant in common has a responsibility to live up to all terms and conditions of the contract, whether it be oral or written, If a portion of the deposit is sent to the tenant in common, the landlord has a legal responsibility to acknowledge why a portion of the deposit was withheld in writing, a tenant continues to have difficulty retrieving a security deposit the tenant in common has the option to take the landlord to small claims court There may be amenities shared between two or more properties, for example, drains and pipes, shared drives or the roof of a block of flats Responsibility for maintaining them and rights to use them, the legal documents may give you as a property owner rights over your neighbor's property If a dispute arises between neighbors about the boundary between their properties, it will be necessary to establish who owns the disputed land Replica Watches. The primary evidence will be contained in the legal documents Clear evidence of this kind is normally conclusive Where there is a shared amenity that is in need of repair the first step is to find out who is responsible for repairs However, the legal documents may not always provide clear evidence and, in this case, it is probably best to settle in advance that the costs will be shared between owners
Disputes can arise between landlords and tenants regarding rented accommodation In many cases, these disputes can be resolved informally between both parties Sometimes however, it is necessary to get an independent and impartial third party involved A third party can hear both sides of the story and decide on the most appropriate resolution A private residential tenancy means a tenancy that is agreed privately between a landlord and a tenant Replica Watches. a tenant aybe renting a room in landlords home,in which case,a legal rights are different from those in private residential tenancies

6 Ways To Fund Your New Business

By:Tim Knox

I'm often asked: what is the best way to finance a new business venture This question is usually followed by "So, do you ever invest in new business ventures?"

The answers, respectively, are: 1 there is no "best" way to fund a new business; and 2 I do invest in new business ventures, but darn it I can't today because I left my checkbook in my other suit

The truth is there are a variety of ways to finance a new business and which way is best for you depends totally on your product, your market, your financial requirements, your burn rate, and most importantly, your personal and financial situation

So with that in mind, here are a few of the most common ways to finance a new business without hitting old Tim up for a loan Keep in mind that all methods have pros and cons and some (or most) may not work for your specific situation No matter what financing method you choose thoroughly investigate the ups and downs and don't jump in with both feet until you're sure you'll land on solid ground

Savings and Investments

The first source you should consider tapping is your own savings and investments I'm a huge fan of self-financing when it comes to business because it doesn't make you responsible to others should the business fail The bad thing is that it if things do go under, it will be your money that goes down with the ship If you're not willing to risk your own capital you certainly shouldn't be willing to risk anyone else's

Friends and Family

After tapping their own savings and investments, many entrepreneurs turn to friends and family for help This works well for some, but here's the creed I live by: NEVER borrow money from anyone you have to eat Thanksgiving dinner with Nothing causes tension in a family like lending money that is never paid back Replica Watches. And notice I say "lending money" rather than investing money Venture capitalists invest money Your relatives lend you money They will expect it back someday even if they say they won't Remember, when a loved one invests in your business they are emotionally investing in you Replica Watches. It would be tough to tell mom and dad that their favorite son lost their life savings because his business went down the drain T8 LED Tube.

Credit Cards

I financed my first business on credit cards, which was an incredibly stupid thing to do given the fact that my business could have failed and left me with thousands of dollars in credit card debt that would have taken until the year 2099 to pay off It worked out in the end for me, but if you decide to finance your business on plastic keep in mind that you will be paying extremely high interest rates on the money you've borrowed and unless you hit it big you will be paying for that money for many years to come

Mortgage The Farm

Bank loans are next to impossible to get if you don't have collateral and a track record of business success, which is why many entrepreneurs use the equity in their homes to finance their business after being turned down for a bank loan While this makes more sense than building a business on a deck of credit cards, the financial risks are no less abundant You must pay this money back whether your business succeeds or not, but it is a good source of low interest money to get you started and the interest may be tax deductible (check with your accountant to make sure)

Angel Investors

An angel investor is typically a wealthy individual who invests in start up ventures for a share of the ownership Angel investors are usually the first formal investors in a business and provide the seed money to get the business up and running Some angel investors will write you a check and leave you alone to run your business while others consider their investment a license to "help you" manage and make decisions If you do accept angel money make sure the terms are clearly defined on both sides Angel money always comes with strings Make sure you know whether those strings come in the form of a bow or a noose before you accept an angel's check

Venture Capitalists

Venture capitalists are to angel investors as pit bulls are to Chihuahuas That's not to say all VC are big, bad dogs, but they do have powerful jaws that can chew up your business and spit it out if things don't go their way VC money doesn't come with strings, it comes with chains and locks and lots of legal documents VC always have the upper hand in any deal they invest in That's just how it works and that's the price you pay to get access to VC money

If your business gets to the level that VC money becomes a viable option, don't jump at the first bone a VC dangles before your eyes If one VC likes your idea, others will, too Present to multiple VC and carefully consider each offer before you accept the check

Just remember, no matter how you finance your business, use the money wisely Don't buy $1,500 plasma monitors and $1,000 Hermann Miller chairs

Have a very clear plan of how the money will be used and how it will be paid back

And remember this, the more you can shoestring the business, but more of the business you will own in the end

Jordan would have raised the tone of the

But there were one pair of notable implants missing from this year's Cartier International Polo. Those of Jordan, or Katie Price as she is now known, who was not only banned from the VIP Cartier tent, but also prevented from buying a table within the Chinawhite enclosure, on account of her being too much of a 'chav' to attend the 'most prestigious sporting event of the season'. And here I was thinking that Chinawhite, Cartier and chavs were like the Three Musketeers; one for all and all for one.
After all, only chavs now frequent the London night club Chinawhite (despite their rumoured efforts to attract a more upmRichard Mille Watchesarket crowd). The club's association with polo seems a little strange given how out of favour it is with the Sloanes, who have long since deserted it for Boujis. Still, it clings on year after year.
Like Burberry, Louis Vuitton and other luxury brands, Cartier too has fallen victim to the curse of the chav. One of their most popular products, the stainless-steel 'Tank' watch, now pops up on all manner of undesirable wrists (at least until they can get their hands on that Rolex, as Wiley sagely warns), including those belonging to the fake breast and nail brigade, bopping around in Pucci-esque dresses at Sunday's polo. Cartier and Chinawhite should realise that whether they like it or not, it's the 'chavs' that pay their bills.
So why wasn't Katie's money welcome last week when she attempted to get a table for her and her friends at the event? It's a mystery. Her rejection is all the odder considering that she has recently had her breast implants reduced in size, dyed her hair brunette, and having always been an avid horse rider, learnt to play polo (even participating in a charity match last month). Which is more than can be said for most of the guests last Sunday, many of whom missed the polo completely in favour of another five bottles of champagne. This was despite the best efforts of a softly spoken Guards representative 'reminding' people that there was polo after lunch, and that 'England were playing, so would they please take time out from their drinking to watch.' Maybe it was too hot to sit and watch the match, and they had forgotten sunscreen (although why this would worry sun-bed addicts I am not entirely sure). Or maybe their five-inch heels rendered them immobile. Maybe they did in fact try to leave the Chinawhite tent but got stuck in the treacherous mud en route. Or it could have been the fact that alcohol was not allowed in the Grandstand. Whatever the reason, the North Stand (where the great unwashed non-members of the Guards Polo Club are housed -- as far away as possible from the people who actually know the rules of the game, and of course the Royal Box) was decidedly empty during the National Anthem, and became even more so after the first chukka. Either no one told them that there were another seven to come or one seven-minute period was quite long enough to be without alcohol -- though at least they were spared the two streakers who turned up towards the end of that match.
So who exactly were Cartier and Chinawhite's esteemed guests, deemed so much 'posher', less 'chavvy' and more suited to pFake Franck Mullerolo than Katie Price? Kelly Brook, (former page three girl/lingerie model turned actress), Caprice (of Wonderbra fame -- is there a theme emerging? ) and Tina Hobley (apparently an actress on the BBC's Holby City). Then of course there were the abundance of white stretched limo-riding City boys and girls swigging from their bottles of vodka while dancing on corporate tables in the Chinawhite tent, before later flailing helplessly around Windsor Park trying to find their limo while all the while wondering how they managed to miss the 'racing'.
Tucked away in the corner of the Chinawhite tent was a gourmet sausage stand, the only available source of latenight food and thus the scene of a constant kebab-shop-style scrum, with men and women fighting over chips and Cumberland hotdogs. In a rare moment of civility, I was offered sustenance while in the queue by one kind individual who opened his blazer to reveal not a hip flask, but a pack of individually wrapped miniature Thorntons sticky toffee cakes sitting neatly in his inside pocket.
How posh.
I was brought swiftly back to reality, however, when I spotted one hapless reveller being shoved into the recovery position by a corduroy-clad drunken stranger yelling into his phone, 'I dunno what his name is. I saw him stumble out of the Chinawhite tent and collapse. He's unconscious. What do I do with him now?' If I hadn't felt grass under my feet and seen a decidedly higher than average smattering of stars in the sky, I'd have thought that I was in Piccadilly Circus. Or hell.

Brad Copper, whose Custom Tripp 43 TNT anchors at Point Richmond, is now the proud possessor of the City of San FranciscBedat & CO Replicao Trophy, one of the two golden spades used to break ground for the Golden Gate Bridge in 1933, for his win in the IRC B class.
Copper took the class with a win in the final race Sunday to maintain his lead over eight competitors, including entries from Saratoga; Newport, R.I.; and Puerto Vallarta, Mexico.
Although he is a newcomer to the Rolex series, Copper is no stranger to the sport.
"I raced for 17 years, many years ago," he said. "I took a hiatus to focus on my career. It's been a long, long time, and modern boats are distinctly different than the old IOR (International Offshore Rule) boats I used to race. Every time I get on this boat I go up the learning curve. The whole campaign is new, the boat, the crew, the sails."
In the 1D35 class, the Diablita, owned by Gary Boell of Brickyard Cove, won the race over San Francisco-based Great Sensation. And Mistral, owned by Edward Durbin of Richmond, won the six-boat Beneteau 36.7 class.
The Rolex series, established in 1964 by the St. Francis Yacht Club in San Francisco, is considered one of the premier sailboat racing events in the world, attracting top sailors from around the United States.
ANOTHER TRIUMPH: The Olympics are over, but there were still medals being awarded in Beijing, China, last weekend. Jessica "Jessie" Lorenz of Kensington is a member of the U.S. Paralympic women's goalball team that beat Denmark last week in sudden-death overtime, then came from behind to beat China 6-5 to win the gold medal Saturday in a sold-out Beijing Institute of Technology Gymnasium.
Goalball was created after World War II to keep blinded veterans physically active, and today it is considered the leading sport for athletes who are blind or visually impaired.
MediaNews staff writer Kristin Bender quotes a note from Lorenz posted from China on her Facebook site: "Nothing is like standing on that medal podium and hearing our national anthem play," Lorenz wrote. "One oddity with having all visually impaired people on the podium was our challenge in finding the appropriate direction to gaze in to show the flag our respect. One of our players spotted it, though -- so there we were, left hands on heart, singing along, most of us with tears in our eyes -- for all the world to see that the USA has the best woman's goalball team in the world."
HELP MAKE HISTORY: The Hercules Historical Society is asking for the greater community's help this weekend in identifying people and places in its collection of photos and in coming forward with images of the town's past.
The society will host a display of photos and other items relating to Hercules history from 11 a.m. to 5 p.m. Saturday and from noon to 4 p.m. Sunday at the Hercules Library, 109 Civic Drive.
"The community is welcome to come and see the display, welcome to come with questions concerning Hercules history, and more than welcome to bring in photos or other items related to our early history to share," the society wrote.
The group will have a computer and scanner at the event to make copies of any photos brought in this weekend.
"We're trying to reach people who are not (necessarily) in the Hercules area, but that may have anything that may be of interest to us," said Lynn Fissell, society secretary.
The society is compiling materials for a planned book about Hercules history. To learn more, send an e-mail toor leave a message at 510-799-7536.
